Our Commitment to Privacy

Niara, Inc. (“Niara”) respects the privacy of individuals who provide us with personal information, including our customers, resellers, distributors, service providers and visitors to our website, and is committed to protect the personal information that is provided to us through our website, by email or by other means.

Niara provides this privacy policy (our “Policy”) to inform individuals of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of www.niara.com and any related subdomains (collectively, our “Site”).

Information Collection and Use

Personal information means any information that may be used to identify an individual, including, but not limited to, a first and last name, email address, postal or physical address or other contact information, occupation, industry, credit card information or other information needed to answer a request, to better provide information and services or to comply with various national, state, provincial or local governmental reporting requirements.

Niara may collect personal information as described below. In each case, we only collect personal information that we believe to be relevant and required to provide an individual with requested information and services and/or to conduct our business. For instance, we may collect and use personal information in connection with:

  • Viewing of product demonstrations

  • Participation in seminars, training courses or events

Notice and Ability to Opt-Out

When personal information is collected, we typically inform the individual at the point of collection or upon our first communication to the individual the purpose for the collection and where appropriate, allow the individual to elect whether to provide the information to Niara and/or specify how we can use such personal information.

Niara provides individuals who elect to receive electronic or other communications the ability to “opt-out” of those communications by sending us a notice to unsubscribe. Niara respects opt-out requests and will discontinue communicating with individuals who have requested not to receive email or other communications from Niara. This means we assume an individual has given us consent to collect and use his/her personal information in accordance with this Policy unless the individual has taken affirmative action to indicate that he/she does not consent (for instance by clicking or checking the appropriate option or box at the point of collection). In some cases, when applicable, Niara will provide an individual with the opportunity to “opt-in.” This means that Niara will require affirmative action from the individual to indicate his/her consent before we use personal information for purposes other than the purpose for which the personal information was submitted.

Sharing and Disclosure of Personal Information

If an individual chooses to provide Niara with personal information, that personal information will be used solely by and transferred only to Niara and its resellers, distributors and service providers, which are those companies contracted by Niara to deliver requested information and services.

An individual’s personal information is typically not shared outside Niara without the individual’s permission, except under conditions explained below. Niara may send personal information to service providers under any of the following circumstances:

  • When we have an individual’s consent to share the information.
  • If sharing an individual’s information is necessary to provide a product or service that is requested. If personal information is shared with third parties we will only provide the information they need to deliver the service. Also, such companies are prohibited from using such personal information for any other purpose.
  • To keep individuals up to date on the latest product announcements, product updates, special offers or other information we think they would like to hear about either from us or from our service providers (unless the individuals have opted out of these types of communications).

We will also disclose personal information if required or permitted to do so by law, or in urgent circumstances, to protect personal safety, the public or our websites. In addition, Niara may sell, transfer or otherwise share some or all of its assets, including your personal information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

Use of Cookies and Automatically Collected Information

When an individual visits our website, we send that individual’s browser a cookie. A cookie is a text-only string of information that a website transfers to the cookie file of the browser on a computer’s hard disk so that the website can remember who an individual visitor is. A cookie will typically contain the name of the domain from which the cookie has come, the “lifetime” of the cookie, and a value, usually a randomly generated unique number.

Individuals have the ability to accept or decline cookies by modifying the settings in their browser, as well as delete any cookies that have been installed in the cookie folder of their browser. However, visitors to our Site may not be able to use all of the Site’s interactive features of if cookies are disabled/deleted.

We may also employ other means to track non-personal information about the web pages and content accessed by visitors at the Niara website and the number of times such content is accessed by a visitor. Niara collects this non-personal information in an effort to better meet the needs of visitors to its website to answer questions, and to improve delivery of information and services to visitors of the website. We do not, however, track our Site visitors over time and across third party websites to provide targeted advertising and we do not specifically respond to Do Not Track (“DNT”) signals. However, some third party websites do keep track of your browsing activities, including across other websites on the Internet, which enables these websites to tailor what they present to you. Browsers may allow the setting of a DNT signal so that third parties know that the user does not want to be tracked.

We may use cookies and automatically collected information to: (i) personalize our Site, such as remembering visitor information so that visitors will not have to re-enter it during their visit or the next time they visit the Site; (ii) provide customized advertisements, content, and information; (iii) monitor and analyze the effectiveness of the Site and third-party marketing activities; (iv) monitor aggregate site usage metrics such as total number of visitors and pages viewed; (v) develop leads for our internal sales group and our business partners and provide direct marketing communications to individuals if they have explicitly consented to receive such communications; (vi) protect the security of our website; and (vii) track individuals’ entries, submissions, and status in any promotions or other activities on the Site.

Accessing and Updating Personal Information

Niara encourages all individuals who provide personal information to Niara to keep their personal information accurate and up to date. Personal information may in many cases be updated by an individual online. Individuals may also request access to their personal information by sending an email to privacy@niara.com.

Children and Privacy

Our Site is a general interest website and Niara does not knowingly collect personal information from children under the age of 13.

Data Security

We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of personal information that we collect and maintain. We cannot, however, ensure or warrant the security of any information transmitted to us or provide through the Site, and you do so at your own risk. Changes to Our Privacy Policy

Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time. If we modify this Policy, we will make it available through the Site, and indicate the date of the latest revision. International Visitors

The Site is hosted in the United States and is intended for visitors located within the United States. If you choose to visit the Site from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing.
